DUNN S.I.R. – Terms & Conditions of Use

• DUNN S.I.R. provides tools for conducting ship inspections,  managing workflows, guide the user, and generate instant inspection reports.
   
• DUNN S.I.R. is not responsible for storing, safeguarding, or retrieving your inspection data.
   
• All inspection data, text, and images you enter remain solely on your device under your control.

• Each app installation has a UUID (Unique User ID) and is for use on a single device.
   

Device & Freemium Policy:

• The App license and Freemium trial are tied to each device installation.
   
• Each device installation is treated independently. Multiple devices under the same Apple or Google account are treated as separate installations.
   
• Each installation is eligible for its own Freemium allocation: 3 free PDFs valid for 3 months, whichever is consumed first.
   
• If you delete the App, change, or upgrade your device, previous Freemium allocations or consumable tokens cannot be recovered, as they are stored locally on your device.

• You are solely responsible for the accuracy, completeness, and security of the data you enter into the App.
   
• You are responsible for creating your own backups. If you delete the App, damage or lose your device, or erase stored content, your data will be permanently lost.
   
• Do not contact DUNN S.I.R. for recovery of inspection data, as we do not receive or store it.

Connectivity Requirements:

• Purchase of subscription or Pay-per-PDF requires internet connectivity.
   
• Sending of PDF reports requires internet connectivity via Wi-Fi or Mobile Data.
   
• DUNN S.I.R. is not responsible for failed transmissions caused by lack of connectivity.

Users downloading the app for the first time are automatically assigned Freemium Status.

Freemium users can generate three (3) PDF reports within a maximum period of three (3) months from date of download.

Each time user generates a PDF, a token is consumed.

Upon expiry of the F.O.C. Freemium subscription, the app reverts to 'Trainee' status which allows full utility of the app, but bars any PDF reports from being generated.

Even without having an active subscription or PDFs remaining, the user can still use STT, take photos, and complete their inspection(s).

To be able to generate and send reports in PDF after consuming the Freemium package,  the user must purchase either:

1) The 'Freelancer' Package to generate 1, 3, 5, or 10 PDF Reports. There is no time limit to use the PDF tokens.

Higher number of PDF bundle, lower the cost per PDF.

OR

2) The  'Professional' time based subscription package to generate Unlimited PDF Reports for the duration purchased.

Longer the duration, lower the cost.

OR

3) The Elite package which allows unlimited reports over an unlimited time.

• Paid features (Pay-per-Use or Subscription) are billed and managed directly through the Apple App Store or Google Play Store.
   
• All billing, refunds, and disputes are subject to Apple or Google policies.
   
• DUNN S.I.R. does not process, receive, or store any payment information.
   
• Subscriptions:

• Paid subscriptions are device-specific.

• Subscriptions may be restored on the same device using Apple or Google’s store restoration features. Be aware that consumable tokens cannot be restored.

• Subscriptions may not be restored on a different device unless the same Apple or Google account is used, and the store supports restoration.
   

Consumable Token Packs (Pay-per-Use PDFs):

• Token packs purchased (e.g., 1, 3, 5, or 10 PDFs) are consumable items.

• Once a token is used to generate a PDF, it is considered consumed.

• Consumables cannot be restored if the app is deleted, the device is changed, or data is lost.

• Each device installation is treated independently; multiple devices under the same Apple or Google account are considered separate installations, each with its own token balance.

• The App is provided “as is” and “as available” basis. We make no guarantee that the App will be available at all times, without interruption, or free from errors.
   
• We make no warranties, express or implied, regarding accuracy, reliability, or fitness for a particular purpose.
   
• You are responsible for verifying all inspection results and reports before relying on them.

• Access to the App may be suspended, limited, or terminated at any time for maintenance, updates, technical reasons, or circumstances beyond our control.
   
• We do not guarantee compatibility of the App with every device, operating system, or configuration.
   
• You acknowledge that downtime, connectivity issues, or performance delays may occur, and DUNN S.I.R. shall not be liable for any damages or losses arising from such interruptions.

To the maximum extent permitted by law, DUNN S.I.R. cannot be held responsible, and denies all blame, for any of the following:

• Data loss, device failure, or inability to access your content.
   
• Damages arising from inspection errors, missed compliance, or reliance on App-generated reports.
   
• Delays or failures by users to fulfill their obligations.
   
• Inability of users to use the App correctly or generate/submit reports.
   
• Submission of incomplete reports, or claims that the App failed to generate a report.
   
• Failure to cover all inspection areas.
   
• Data loss due to insufficient device storage, deletion, uninstallation, or device damage/loss.
   
• Any injury, accident, or harm suffered by users while using the App.
   
• User-generated content, including inappropriate images, offensive language, or misuse of the App.
   
• Indirect, incidental, or consequential damages of any kind, including but not limited to:

• App Failure.

• Denial of service caused by device malfunction or incompatibility.

• Or any other glitches
  
   

DUNN S.I.R. shall not be held liable or responsible for any failure or delay in performance caused by events outside our reasonable control, including but not limited to:

• Acts of God, natural disasters, or extreme weather.
   
• Fire, flood, earthquakes, or epidemics.
   
• War, terrorism, armed conflict, or electromagnetic pulse (EMP) events.
   
• Government actions, sanctions, trade restrictions, or regulatory changes.
   
• Labor disputes, strikes, or industrial disturbances.
   
• Failures of telecommunications, internet, hosting, or third-party services.
   
• Removal or suspension of the App from the Apple App Store or Google Play Store by Apple or Google.
   

In any such case, obligations under these Terms will be suspended for the duration of the event, and we will not be liable for any resulting damages, losses, disruptions, or litigations.
